Presumption
Presumption is when the court presumes something before the case even begins.
There is a set of books in every decent law library called "Corpus Juris Secundum, An Entire Restatement of the American Law".
I have an older set and it is about 150 volumes and each volume is around 500 pages. There is not one page that doesn't have a case where a presumption can be made by a court.
Presumptions are ALWAYS taken under color of law, and without any authority whatsoever.
Presumptions are ONLY taken by Admiralty Maritime Law courts. Common Law Courts never presume anything. In our modern civilization, because there are so many people who are so clueless about the law and how it works, there are few if any, truly common law courts and administrators called Judges actually wear several hats. Judges in all courts these days can wear a common law hat, or an Admiralty Maritime Law hat. It all depends on the pleadings that are presented.
For example
1 If somebody comes up to you on the street that says; "You owe me $50.00", and you pay it to them, then you must have owed it, right?
2 If somebody comes up to you on the street and says; "You owe me $50.00", and you say, "I already sent you $10.00", then you are admitting that there is a contract, and you are arguing the terms of the contract.
3 If somebody comes up to you on the street that says; "You owe me $50.00", and you say; "I haven't agreed to pay you anything?", then you are challenging the existence of a contract.
The same thing holds true for government bureaucrats, but few people understand how it works.
1 If a bureaucrat makes a presumption, and comes up to you on the street that says; "You should be do this (get a building permit)", and you apologize and then proceed to do it, then you must be subject to their codes, rules and regulations, right?
2 If a bureaucrat makes a presumption, and comes up to you on the street that says; "You should be do this (get a building permit)", and you say; "I don't have to do it for 30 days.", or "This is not the type of building that requires a permit", then you are admitting that you have agreed to their contract, and you are arguing the terms of the contract.
3 If a bureaucrat makes a presumption and comes up to you on the street that says; "You should be do this (get a building permit)", and you say; "I am not a "person" as provided for by your codes, rules, and regulations, and you are commiting a felony to violating My rights under the color of law.", then you can watch him dive for cover.
There are a myriad of reasons why a bureaucrat might want to talk to you but rest assured, I don't care what it is, they have no authority whatsoever, and it is always under color of law. You need to be extremely careful about telling them anything, because remember what they tell you when they read you your rights; "Anything you say can and will be used against you in a court of law."
If you tell them anything, it may be deemed to be giving up your rights, and absolutely NEVER say anything that could be viewed as a lie. Remember, how Martha Stewart, was put in jail recently for lying to investigators. She was not put in jail for any crimes that resulted in the investigation. Also, they presumed she was a US citizen.
